In a contested divorce the parties disagree on the divorce itself or its consequences; fault, evidence and claims are examined throughout the trial. Careful preparation of the file is essential.
Custody and Alimony
Custody is determined according to the best interests of the child. The court considers the child’s age and needs, the parents’ living conditions and, where necessary, expert opinions.
Types of maintenance include interim maintenance during proceedings, post-divorce alimony and child support. Amounts are set according to the parties’ financial circumstances and may later be increased or reduced if conditions change.
Matrimonial Property
Unless the spouses agreed otherwise, the statutory regime for marriages after 2002 is participation in acquired property. Division of assets acquired during the marriage is claimed in separate proceedings and involves technical calculations.
